The following terms and conditions set forth the legally binding terms for the use and access of all *ePUBLICITYpr.com & its Subsidiaries’ (hereafter referred to as ePUBLICITYpr.com) content and services including but not restricted to ePUBLICITYpr.com. By accessing or using ePUBLICITYpr.com content or services you (hereby referred to as ‘member’ or ‘user’) agree to be bound by these conditions. Should you not agree with the terms and conditions you should discontinue access or use of ePUBLICITYpr.com content or services. ePUBLICITYpr.com reserves the right to alter these terms and conditions at its sole discretion and continued use of ePUBLICITYpr.com content or services constitutes an acceptance of these revised terms and conditions.

 

Unless otherwise specified, all content produced by ePUBLICITYpr.com including but not limited to ePUBLICITYpr.com, and may not be transferred or reproduced without the express permission from the ePUBLICITYpr.com management team.

ePUBLICITYpr.com takes pride in innovation but do not take responsibility for any malfunction or damage resulting from the use or access of materials or services. While ePUBLICITYpr.com uses high quality graphics and large quantities of text it does not take responsibility for the use of printer ink by users who print any part of our content or service.

 

All images and content are owned by their respective owners. All rights reserved. Respectively, any images uses in flash presentation on ePUBLICITYpr.com are the property of their owners and ePUBLICITYpr.com does not claim stake in any of the images at any time.

 

Any information obtained through registration will not be sold to third parties by ePUBLICITYpr.com, but ePUBLICITYpr.com reserves the right to use information for its own promotional activities and communications. ePUBLICITYpr.com reserves the right to disclose user information as required by law and should ePUBLICITYpr.com believe that such disclosure is necessary to protect our rights and / or to comply with a judicial proceeding, court order or legal process.

 

The use or accessing of any ePUBLICITYpr.com content or service does not in any way mean that you are affiliated with ePUBLICITYpr.com and we will not be held responsible for any misuse or offense that arises from third party use or accessing of content or services.

 

While all content outlined in this agreement is pertaining to all of ePUBLICITYpr.com’s services/sites (including ePUBLICITYpr.com), this section expounds upon the agreement and is specifically pertaining to ePUBLICITYpr.com, but not limited to (as all content in this agreement that is set forth), is also applicable to other ePUBLICITYpr.com services and content.

 

All content provided by users in press releases must be factual, and free from any derogatory information. No nudity, no infringement, no profanity, no racism, no bigotry, material that is likely to cause offense or unconfirmed information is allowed. ePUBLICITYpr.com will not be held liable for any of the content submitted by users of their services. Accountability and liability will be the sole responsibility of the user. If you have paid a fee for this service and have broken any of the rules set forth here, you will forfeit the remaining funds (due to inconvenience and embarrassment) and your account will be immediately terminated and your press release(s), EPK or audio will be removed from the website (NO EXCEPTIONS), and no refund will be awarded to you for breaking the implemented rules.

 

SPECIFIC TO REFUND POLICY:

Monthly packages may be cancelled at any time without any risk or contract - you will not incur any additional charges. For yearly packages, we are offering a full 30-day trial in which you may try the service before you buy. Because we have deeply discounted our yearly package, there will be no refund granted beyond the 30-day trial (or if you have reached the maximum allowance of sending credits [50 per individual publicity service - example: 50 sending of press releases, 50 sending of EPKs, etc.] under the trial period - at that time, the system will prompt you to begin full service). However, you are not tied to a contract, so you may cancel the yearly package from recurring further prior to your anniversary date. Please be advised that ePUBLICITYpr.com reserves the right to change the term of its free trial offering at any time without notice.

 

ALL RECURRING PACKAGES AUTO-RENEW UNLESS OTHERWISE SPECIFIED OR YOU CANCEL PRIOR TO THE DUE DATE. NO E-MAIL OR LETTER MAY BE SENT OUT PERTAINING TO THE RECURRING PAYMENT, AND PAYMENT WILL AUTOMATICALLY BE DEDUCTED EACH TIME OF ANNIVERSARY OF THE INITIAL SET UP. PLEASE CANCEL BEFORE THE RENEWAL DUE DATE IF YOU DO NOT WANT TO BE CHARGED PAST THE ANNIVERSARY DATE.

 

ePUBLICITYpr.com is not held liable for any materials sent out, and how they appear in the inbox of its recipients – this has nothing to do with the ePUBLICITYpr.com system, but the e-mail provider. ePUBLICITYpr.com warns users to use service at their own risk, though the site has been thoroughly tested and all measures have been taken to give to its users a problem-free service, ePUBLICITYpr.com will not be held liable for mishaps, downtime of the site or any other problems that may occur with or as a result of using the service.

 

Because ePUBLICITYpr.com cannot control if an EPK, press release or music distribution form is sent to the spam or junk bin of an intended recipient, we will not be held liable for this, as it is an issue with the e-mail provider, and not with our service’s delivery.

 

This service is non-transferable, and the user who uses the service, must be the person who either signed up, or represents the person who is signed up for the service. ePUBLICITYpr.com will not be held liable for people who sign up for accounts should they not be the account holder.

 

All users MUST own the rights to the music; videos and lyrics used in their EPK or music distribution service, or have express permission to use the materials on their behalf. THERE IS NOT EXCEPTION REGARDING THIS.

Absolutely no spamming of email accounts will be tolerated by users using ePUBLICITYpr.com services.

 

No submitting a press release or EPK without express permission from the subject referenced in the either the press release or EPK (Electronic Press Kit).

 

No creating a press release or EPK without the express permission from the subject referenced.

 

ePUBLICITYpr.com reserves the right to immediately terminate a user's account with no refund given should they feel users did not comply with the regulations pertaining to proper use of the service.

 

Eligibility:

1. Use and membership of ePUBLICITYpr.com requires that any registration information is truthful and accurate and that the accuracy of said information will be maintained by the user.

 

2. In the use of content or services provided by ePUBLICITYpr.com you shall not violate any applicable law or regulation.

 

3. Due to occasional adult themed content you must be at least 15 years of age to access ePUBLICITYpr.com content. Should ePUBLICITYpr.com find that you are under 15 years of age your membership and access will be terminated.

 

Term:

This agreement will remain in force for the duration of your use of services and content. You may terminate your use and / or membership of ePUBLICITYpr.com and related content at any time. ePUBLICITYpr.com reserves the right to terminate your membership or use of our services or content at any time without prior notice. Following termination of the service you will still be bound to the terms of this agreement.

 

Fees and cost:

ePUBLICITYpr.com reserves the right to charge for the use of its services at its discretion. No refund will be permitted to those whose use or membership has been terminated by ePUBLICITYpr.com due to neglect in following our terms of services. The user is liable for any applicable taxes for hardware. Software, service and any other costs you may incur in connection with the use or access of ePUBLICITYpr.com.

 

Password:

The confidentiality of any passwords use to access or use ePUBLICITYpr.com material is your sole responsibility and you agree not to use the name, password or any other details relating to that of another user at any time. You are solely responsible for your use and access of ePUBLICITYpr.com content and services and ePUBLICITYpr.com will not be held responsible for any problems stemming from the breaking of this agreement.

 

Use of service:

Content and services are intended for the personal use of members only and may not be used for commercial endeavors other than those sanctioned by ePUBLICITYpr.com. Illegal use of services, content and information is prohibited. Commercial advertisements, links and other solicitations may be removed from profiles without notice and may result in the termination of membership. Appropriate legal action will be taken for misuse of services by users.

ePUBLICITYpr.com content and services are provided for users to build relationships as part of a community of like-minded users and not for exploitation. ePUBLICITYpr.com services are provided to allow users to promote and market their artistry, business or other services. ePUBLICITYpr.com seek to provide a useful tool for its users - not for users to annoy, spam, intimidate or in any other way cause offence or distress. If you cannot adhere to the rules of use you should end your use and accessing of the services and content that is provided immediately. Users found not to be in compliance with with the provision of ePUBLICITYpr.com services will have their contract terminated without refund.

 

Ownership:

ePUBLICITYpr.com does not claim ownership or responsibility for text, images, photos, video, sounds or any other materials posted by users. Any content posted to ePUBLICITYpr.com by users remains the province of the user that posted it. ePUBLICITYpr.com reserves the right to limited use of any content posted by users for performance, modification, public display, reproduction and distribution through ePUBLICITYpr.com services.

 

This right to limited use of content is to allow ePUBLICITYpr.com to continue to provide and promote their services. Without such an agreement ePUBLICITYpr.com would be unable, for example, to compress music files to satisfy technical needs while without public performance requirements ePUBLICITYpr.com would be unable to allow other members to access and listen to music posted to ePUBLICITYpr.com. This agreement is not exclusive (you can license your content to anyone else alongside ePUBLICITYpr.com), royalty free (ePUBLICITYpr.com is not required to pay you for the use of content that you post), sub licensable (so, for example, ePUBLICITYpr.com can use affiliates such as delivery networks to provide services) and worldwide. This agreement will terminate once the content is removed from ePUBLICITYpr.com. This agreement does not give ePUBLICITYpr.com the right to sell your content or distribute it outside of ePUBLICITYpr.com services.

 

All users confirm and warrant that they own content posted on or through ePUBLICITYpr.com or have the right to grant license to post said material. The posting of content should not violate the privacy rights, publicity rights, copyright, contract rights or any other rights of another person. You agree to pay any royalties, fees and other monies owing to another person for reason of your posting of content to ePUBLICITYpr.com. ePUBLICITYpr.com will not be held responsible for any legal action stemming from the breaking of these rules.

 

ePUBLICITYpr.com content and services remain under the ownership of ePUBLICITYpr.com although ePUBLICITYpr.com grants the limited right for users to reproduce and display ePUBLICITYpr.com content solely for the purposes of using or accessing said content. You may not modify, copy, publish, transmit, distribute, sell, perform or any other way misuse content posted by ePUBLICITYpr.com without the express permission of the management team.

 

Content:

ePUBLICITYpr.com reserves the right to delete any content that in ePUBLICITYpr.com sole judgment is deemed offensive, illegal or violates the rights, harms or threatens the safety of another person. ePUBLICITYpr.com assumes no responsibility for the monitoring or removal of content that it deems inappropriate or conduct that it deems to break the terms of this agreement, although ePUBLICITYpr.com reserves the right to such monitoring and removal at its discretion. Respectively, ePUBLICITYpr.com may edit content that will appear on our homepage for clarity, grammar or syntax. We reserve the right to remove any content from our homepage press releases that is improperly formatted or does not adhere to our terms of service. We may do this without prior notice. All users EPKs will not show on the homepage. You agree that you have read our tutorial on press releases prior to submitting a press release onto our system.

 

Press releases delete off of our homepage after 7-days to allow for new press releases to show. Your direct URL will allow you to access your press release or give the link to people at any time. You may post up to two press releases a day, so that the homepage distribution process will be fair. 'Unlimited' press releases refer to the fact that we do not charge you per press releases, and allow for it to come standard in our 'Ultimate' package. For Unlimited press release packages, you may not post more than two press releases per day if it is for different clients/subject matter. Please contact us if you have reached your limit, and need to post more individualized press releases.

 

You are solely responsible for any content that is posted on or through the use of ePUBLICITYpr.com. ePUBLICITYpr.com does not endorse or have control of content posted by users and any content does not necessarily reflect the opinion or policy of ePUBLICITYpr.com. ePUBLICITYpr.com makes no warranties for the accuracy or reliability of content posted on or through its services.

 

Material posted by ePUBLICITYpr.com are deemed ‘opinion only’ and ePUBLICITYpr.com shall under no circumstances be held liable for the opinions expressed therein, in accordance to Freedom of Speech.

Advertising content are the sole responsibility of the advertisers and ePUBLICITYpr.com will not be held liable for the content, but will do their best to make sure that content is acceptable.

 

All competitions and specials are the sole responsibility of its owners and creators of the contests, and while ePUBLICITYpr.com will do everything in their power to ensure these are screened appropriately, they will not be held liable for inconvenience, damage or other difficulty that arises from participation in any contest. All material is to be rendered by the owner of the competition or the special, and ePUBLICITYpr.com will not be bound to supply any materials to anyone.

 

Prohibited activity and content:

The following is list is not exhaustive and provides guidelines for content or activity that is prohibited by ePUBLICITYpr.com. *ePUBLICITYpr.com reserves the right to investigate and take legal action against persons who, in their sole judgment, is believed to be in violation of this provision. Prohibited content is inclusive of but not limited to that, which in the sole judgment of ePUBLICITYpr.com:

 

1. Is patently offensive and promotes bigotry, racism, hatred or harm whether physical or mental against any group or individual.

 

2. Advocates the harassment or harasses any group or person.

 

3. Is sexually or violently exploitative.

 

4. Contains nudity, violence or offensive content or links to a site that is adult in content or relates to offensive content.

 

5. Solicits personal information from anyone under the age of 18.

 

6. Provides personal details including email addresses, postal addresses or telephone numbers.

 

7. Promotes false, illegal, abusive, threatening obscene or libelous information.

 

8. Promotes the illegal use or copying of any person’s copyrighted work.

 

9. Involves the sending of junk mail, chain letters or any other type of unsolicited mass mailing including ‘spamming.’

 

10. Contains restricted or password protected material.

 

11. Promotes or furthers any criminal activity.

 

12. Involves commercial activities such as sales, advertising, pyramid schemes or contests without consent from the ePUBLICITYpr.com management team.

 

13. Includes photographs or images posted without subject’s consent.

 

14. Uses misleading or deceptive content to draw attention to the content posted by a user.

 

15. The sending of harmful files.

 

16. Covering or obscuring banner advertisements on your or any other page.

 

17. Any automated use of the ePUBLICITYpr.com.

18. Creating unnecessary burden or interference with the ePUBLICITYpr.com systems.

 

19. Impersonating another user, member, employee of ePUBLICITYpr.com or any other person.

 

20. Selling or transferring of your profile.

 

21. Using any information gained from ePUBLICITYpr.com to harass, abuse or in any way harm another person.

 

22. Using ePUBLICITYpr.com to gain significant payment for any service or performance of a commercial nature.

 

23. Using ePUBLICITYpr.com or its services in a manner that violates any applicable laws and regulations.
